How it is calculated

Every notice has a code (DRC-01, GSTR-3A, ASMT-10, REG-17 for GST; 143(1), 139(9), 142(1), 143(2), 148, 245 for income tax). This decoder maps each to its meaning, urgency, the response deadline, a short action plan, and the exact reply form. Always follow the specific deadline printed on your own notice, and get professional help for high-urgency demands and reassessments.

Read the deadline before you read the allegation

Every notice carries a period to respond, and that date governs everything else. A section 143(1) intimation generally allows 30 days on a proposed adjustment; a GST DRC-01 states its own reply period; a defective-return notice under section 139(9) commonly gives 15 days, and letting it lapse can render the return invalid. A strong reply filed late is worth less than an adequate one filed on time.

The word 'notice' covers very different things

The correct level of alarm varies enormously. A 143(1) intimation is often arithmetic and sometimes confirms a refund. A section 245 communication proposes adjusting your refund against an earlier demand. A 139(9) notice says the return is defective and fixable. A section 148 notice is a reassessment and is genuinely serious. In GST, DRC-01A is a pre-notice intimation inviting you to settle before formal proceedings, while REG-17 proposes cancelling your registration.

Silence converts a question into a finding

Not replying does not make the matter lapse; it removes your version from the record. Under section 144 the officer may complete a best-judgment assessment on their own estimate, which rarely favours the taxpayer. In GST, allowing the reply window on a show-cause notice to pass results in a confirmed demand order. Even an incomplete reply seeking time is far better than no reply.

Answer with documents, in the notice's own order

Identify the notice by number, date and section. Address each point in the sequence raised, stating clearly what you accept and what you dispute, and attach the evidence for each disputed item — challans, bank statements, invoices, contracts, Form 26AS or AIS extracts, GSTR-2B. Do not assert what you cannot evidence, and do not volunteer material the notice did not seek. File through the portal where one exists and keep the acknowledgement.

Know when the reply stops being a self-help task

Handle arithmetical and routine matters yourself. Bring in a chartered accountant or advocate where reassessment, penalty or prosecution provisions are cited, where fraud or wilful suppression is alleged, where the amount is significant, or where an appeal with a pre-deposit is in prospect. The first reply frames the record for everything that follows, and correcting it on appeal costs far more than getting it right at the outset.

Frequently asked questions

What is a GST DRC-01 notice?

DRC-01 is a show-cause notice proposing a demand of tax, interest and penalty under section 73 (non-fraud) or 74 (fraud). You reply in Form GST DRC-06, usually within 30 days — pay any genuine dues via DRC-03 and contest the rest.

What does a GSTR-3A notice mean?

It is issued for not filing your GST returns. File the pending GSTR-1/GSTR-3B within 15 days; continued non-filing can lead to a best-judgment assessment and cancellation of registration.

What is a 143(1) intimation?

An automated summary after your ITR is processed, comparing your figures with the department's. If it shows a demand you disagree with, file a rectification under section 154; otherwise no action is needed.

How serious is a section 148 notice?

Very — it reopens a past year for income that allegedly escaped assessment, with strict timelines. Check the reasons recorded, file the return if asked, and get professional help.
